Personal Care Proxy (Power of Attorney for Personal Care)
If you do not have a Personal Care Proxy
(Power of Attorney for Personal Care) in place and you become mentally incapable of making healthcare or personal care decisions for yourself,
the
Health Care Consent Act allows Other Substitute Decision-makers to make
some of these decisions on your behalf.
These decisions include:
- Your healthcare and treatment
- Your admission to a long-term care facility
- Personal assistance services such as bathing
If you do not have a Power of Attorney for Personal Care in place and you become mentally incapable of making a decision about a required medical treatment,
your doctor must get consent from a third party. That person will be chosen from the following list.
Your doctor must start with the first person on this list and continue down the list until he finds someone able, willing,
and available to make the decision on your behalf. The person chosen to make the decision is called your Other Substitute Decision-maker.
Your Other Substitute Decision-maker will be one of the following:
- Your "representative".
A representative is the person who is appointed to you by the The Office of the Public Guardian and Trustee (OPGT) when you do
not have a Power of Attorney for Personal Care in place.
The job of your representative is to make decisions on your behalf about your medical treatment, admission to a long-term care facility, or personal assistance.
- Your spouse or partner.
- Any offspring over the age of 16 years.
- Your parent.
- Any of your siblings over the age of 16 years.
- Any other relative.
- The Office of the Public Guardian and Trustee.
Having a Proxy for Personal Care set up in advance of this need will save your doctor valuable time in an emergency and
everyone involved much stress. If you do not want this list to determine who will be responsible for your personal care
be sure to obtain and complete a Power of Attorney for Personal Care to name the person you prefer.

Although none of us likes to think about being incapacitated by illness or an accident, it does happen and it's best to be prepared just in case.

Your assets will be frozen. If you have people depending on you, there is nothing they can do except apply to the court
for the power to act on your behalf, unless you've given someone Power of Attorney to take care of your financial affairs in advance.
